This agreement is between you, an adult member (18 years or older) of the Brevard NEXT program, and Youth FIRST Athletics, LLC ("the Company"), its owner, coaches, employees, and agents. In the app you accept this document by checkbox at signup; that acceptance is recorded with your name, the document version, and a timestamp, and has the effect of your signature.
Brevard NEXT provides adult fitness training and related services: strength and conditioning sessions, workout programming, fitness assessments and benchmarks, mobility work, and general (non-medical) nutrition and habit guidance, delivered in person and through the Brevard NEXT app.
Physical training carries inherent risks that cannot be eliminated even with careful instruction and supervision, including but not limited to: muscle strains and sprains, broken bones, joint injuries, heat-related illness, cardiovascular events, aggravation of pre-existing conditions, and — in rare cases — permanent disability or death. You voluntarily accept and assume all such risks, whether arising from the activities themselves, the facilities and equipment used, or the actions of other participants.
You confirm that you are physically able to participate, that you have answered the health-screening questions honestly (see the separate Informed Consent & Health Screening document), and that you will inform your coach of any injury, illness, pregnancy, or medical condition that could affect safe participation — before it becomes a problem mid-session. A physician's clearance is strongly recommended before starting any new exercise program.
To the fullest extent permitted by Florida law, you release, waive, and discharge the Company from any and all claims, demands, or causes of action arising out of or related to your participation, including claims based on the ordinary negligence of the Company. This release does not extend to gross negligence, willful misconduct, or any liability that Florida law does not permit to be waived.
You agree to indemnify and hold the Company harmless from claims brought by third parties arising out of your own acts or omissions during participation.
You authorize the Company to obtain emergency medical treatment on your behalf if you are unable to consent in the moment. You are responsible for the costs of any such treatment.
If any part of this agreement is held unenforceable, the remainder stays in effect. This agreement is governed by the laws of the State of Florida; venue for any dispute lies in Brevard County, Florida.
You confirm that you are at least 18 years old, that you have read this entire document, that you understand it is a waiver of legal rights, and that you accept it freely and voluntarily.
